In September 2015, the Securities and Exchange Commission (SEC) announced fraud charges against Maryland-based Bennett Group Financial Services and its founder, Dawn J. Bennett (CRD# 1567051) for allegedly grossly inflating the amount of managed assets and exaggerating the investment returns actually obtained for customers.
The SEC alleged that Dawn J. Bennett frequently touted to customers and more broadly on her paid radio program that highly profitable investment returns generated by Bennett Group Financial Services placed it in the “top 1 percent” of firms worldwide without disclosing that the returns were calculated for a model portfolio and not based on actual investor performance. The SEC Enforcement Division also alleged that Dawn Bennett and her firm claimed to be managing more than $2 billion in assets when the real number was no more than one-fifth of that amount.
In addition, in November 2015, Dawn Bennett was permitted to resign from the brokerage firm that she was registered with following the discovery of "promissory notes with firm customers" by Dawn Bennett's company without disclosure to the firm. Based on this disclosure, it is unclear whether the investors purchased promissory notes in Bennett Group Financial Services, or in one of Dawn Bennett's other companies such as BG Media Productions or DJB Holdings.
Brokerage firms like the ones Dawn Bennett was registered with have a duty to properly supervise their representatives like Dawn Bennett to ensure that the investments that they recommend to customers are suitable for their needs, and can be held liable for the misconduct of its agents.
In addition, if stockbroker like Dawn Bennett sells investments (such as promissory notes) that are not approved by the brokerage firm, both the stockbroker and brokerage firms with which they are registered may be held liable if investors suffer losses in unapproved investments.
